1. About these terms
These terms apply when you use the STARX FAST WIFI website, dashboards, customer WiFi pages and any other part of our service. We call all of that "the service". "We", "us" and "our" mean STARX FAST WIFI. "You" means the person using the service.
There are three kinds of people who use the service, and some parts of these terms apply to only one of them:
- WiFi owners run a WiFi network and use our tools to sell access and collect payments. This includes partners who use equipment we supply.
- WiFi customers are the people who pay to use a WiFi owner's network.
- Visitors are people who browse this website.
By creating an account, paying for access or using the service, you agree to these terms. If you do not agree, please do not use the service.
2. What we do
We provide software that lets WiFi owners set prices, accept payments by mobile money or bank transfer, give customers access when they have paid, switch access off when time or data runs out, and see their sales.
Who provides the internet? When you buy access on a WiFi owner's network, the owner provides the internet connection and decides what to charge. We provide the tools that take your payment and open the connection. In our partner arrangement, where we supply and look after the router, we and the owner share that role, and the owner is still the person you deal with locally.
We are not a bank, a mobile money operator or a telecoms company. Payments are handled by licensed payment partners.
3. Who can use it
- You must be at least 18 years old, or have a parent or guardian's permission, and be able to enter a binding agreement.
- If you sign up for a business, you promise you have the authority to act for it.
- The information you give us must be true and kept up to date.
- You must follow the laws that apply to you, including any rules about sharing or reselling internet access where you live.
4. Your account
- Keep your password private. You are responsible for what happens under your account.
- Tell us straight away if you think someone else has got into your account.
- One person or business should not hold several accounts to avoid fees, limits or a suspension.
- We may ask you to confirm who you are or where your WiFi is, for example before a withdrawal.
5. Fees and payments
Our current fees are on the pricing page. There are two ways to work with us:
- Own router: you pay a flat monthly fee in your country's currency and keep your sales.
- Partner: there is no monthly fee. We keep an agreed share of each sale and you receive the rest.
Monthly fees are charged in advance for each month. If a fee is late you get a short grace period. After that, new sales may pause until you pay. Customers who are already connected keep the time they paid for.
If we change our prices, we will tell you before the change applies to you. Prices shown to you do not include any taxes that apply, and you are responsible for the taxes on your own income.
6. The money you collect
- When customers pay, the money is recorded in your balance, after any share we are due.
- You can ask to withdraw your balance to your mobile money wallet or bank account. There may be a minimum amount, which is shown in your dashboard and on the pricing page.
- Payouts depend on our payment partners, so timing can vary. We will tell you if something is delayed.
- We may hold or reverse a payment while we look into fraud, a mistake, a dispute or a legal request. We will explain why, unless the law stops us.
- We may take any amount you owe us, such as fees or refunds you are responsible for, out of your balance.
7. If you are a WiFi owner
- You decide your prices, plans and speeds. They must be shown to customers clearly and honestly, and you must deliver what you sell.
- You are responsible for the quality of your internet connection, your equipment and your customer support.
- You are responsible for having any licence, permission or agreement you need to sell internet access, including with your own internet provider.
- Customers' personal information is handled as described in our Privacy policy. You must not misuse it, and you must follow the data protection laws that apply to you.
- You must handle customer complaints fairly and follow our Refunds policy.
8. If you are a WiFi customer
- You are buying a set amount of time or data on the owner's network. It starts when your payment is confirmed.
- Your access code is for you. Do not share it or try to use it on devices you have not paid for, unless your plan allows several devices.
- Speeds can vary. The owner's connection, the number of people online and the place you are in all affect it.
- If you paid and did not get access, see our Refunds policy and contact the owner or us.
- Please follow the Acceptable use policy.
9. Rules of use
Everyone using the service must follow the Acceptable use policy. In short: no illegal activity, no fraud, no attacks on the service or on other people, and no trying to get access you have not paid for.
10. Service quality
- We work hard to keep the service running and to fix problems quickly, but we cannot promise that it will always be available or error free.
- Parts of the service depend on others: mobile networks, mobile money operators, banks, SMS providers, hosting companies and your own equipment. We are not responsible for problems that they cause.
- We may carry out maintenance or improve the service. Where we can, we will warn you before something important changes.
11. Who owns what
- We own the service, its software, design and branding. You get a personal, limited permission to use it while you follow these terms.
- You keep the rights to your own business name, logo and content. You allow us to show them to your customers as part of the service.
- Please do not copy, resell or reverse-engineer the service, or use our name in a way that suggests we endorse you without our agreement.
- If you send us ideas or feedback, we may use them without owing you anything.
12. Suspension and ending
You can stop at any time. Tell us you want to close your account. Withdraw your balance first. A monthly fee that is already paid covers the rest of that month. Closing the account does not cancel money you already owe.
We may suspend or close an account if you break these terms, put customers or others at risk, do not pay what you owe, or if the law requires us to. Where it is fair and safe to do so, we will warn you first and give you a chance to fix the problem.
After an account closes, we pay out any balance you are properly owed, after deducting what you owe us and after any checks we must complete. Parts of these terms that are meant to continue, such as how we handle disagreements, still apply.
13. Our responsibility
- Nothing in these terms limits responsibility that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud. Your rights as a consumer under local law stay as they are.
- Otherwise, we are not responsible for losses that we could not reasonably have foreseen, or for lost profits, lost business or lost data that come from using, or being unable to use, the service.
- Our total responsibility to you for any one issue is limited to the fees you paid us in the twelve months before the issue happened.
- The service is provided "as is". We give no promises beyond those written in these terms.
- You agree to cover us for claims and costs that come from your breach of these terms or your misuse of the service, for example if you sell customers something misleading or break the law.
14. Disagreements
If something goes wrong, please contact us first. Most problems can be solved with a conversation, and we will do our best to put things right.
These terms are governed by the laws of the country where you created your account (for example Kenya, Tanzania, Ghana or Nigeria), and the courts of that country can hear any dispute we cannot settle ourselves, unless the law gives you the right to go elsewhere.
15. Changes
We may update these terms as the service or the law changes. When we make an important change, we will tell you by email, in your dashboard or on this website before it applies. The date at the top of this page shows when it was last updated. If you keep using the service after a change takes effect, you accept the new terms. If you do not accept them, you can close your account.
16. The small print
- These terms, together with our Privacy policy, Cookies notice, Refunds policy and Acceptable use policy, are the whole agreement between you and us about the service.
- If a part of these terms turns out to be unenforceable, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your account to someone else without our agreement. We may transfer our rights to a successor to our business, and we will let you know.
- We are not responsible for delays caused by things outside our control, such as power cuts, network failures, natural disasters or actions of authorities.
